Selling Property In Jamaica

When selling, the margin between a smooth closing and a stalled one often comes down to the quality of your legal team. We prepare and manage every document the transaction requires — giving you and your purchaser confidence at every stage.

Transfer Tax is 2% of the sale price or appraised value, whichever is higher, and is payable by the vendor. We calculate and file it, and where your property is subject to an existing mortgage, we obtain the mortgage statement, coordinate with your lender, and settle the outstanding balance from the sale proceeds so the title can transfer clear.

Title Transfers & Registration

Title work takes many forms — transfers between family members, transfers from estates to beneficiaries, noting the death of a joint tenant, lost title applications, first registration of unregistered land, and claims in adverse possession. Every change to the title record must be properly registered at the National Land Agency to take legal effect.

Transfer Tax may be waived in certain circumstances. The most straightforward is a transfer between spouses, which generally attracts no Transfer Tax. Transfers between parents and children can also be exempted, though these typically require additional supporting steps. Where one proprietor of a jointly-owned property has passed away, we attend to noting the death on the title so the surviving proprietor's interest is properly reflected.

For land that has never been brought under the Registration of Titles Act, we handle first registration — surveying coordination, application preparation, and statutory advertisement. Where a person has occupied land openly and continuously for the required statutory period, we also prepare and lodge adverse possession applications to have ownership formally recognised.

What You Actually Pay At Closing.

A Jamaican property transaction involves several statutory and professional costs. Below is a plain-language breakdown — the full calculation for your specific matter is provided in writing at your consultation.

Stamp Duty

A flat JMD $5,000, split equally between the buyer and seller on the Agreement for Sale.

Registration Fee

0.5% of the sale price, split equally between buyer and seller, paid to the National Land Agency.

Transfer Tax (Seller Only)

2% of the sale price or appraised value — whichever is higher. Payable by the vendor only. May be waived in certain family transfers.

Agreement For Sale

A typical fee of JMD $120,000 for preparing and reviewing the AFS, commonly split equally between parties.

Legal Fees

Approximately 1% to 3% of the sale price for conveyancing work, payable by each party to their own attorney.

Non-resident buyers complete the same conveyancing process as local purchasers, and take title in the same form. Documents are couriered securely, consultations are conducted by video, and funds are held in our regulated trust account until completion. The specific mechanics of a remote closing depend on the transaction and are discussed at your consultation.
